Experienced Appleton Real Estate Attorneys Protect You during Transactions
A real estate lawyer helps you avoid potential pitfalls
The purchase and sale of property is both exciting and risky. Homeowners and homebuyers have to be aware both of their rights and their obligations during the sale period to ensure a smooth transaction. What may seem like a small oversight during the process can often have serious long-term consequences.
Van Hoof & Schneider Law Firm performs real estate attorney services for our clients in Little Chute, Appleton and the surrounding Northeast Wisconsin communities. If you are considering the purchase or sale of real estate, or are involved in a foreclosure, our real estate attorneys work to give you legal protection during the process.
Our real estate attorneys can handle all phases of a residential real estate transaction
The purchase and sale of property, from prospective interest to the actual closing, is a long process. As well, divorce or bankruptcy can have major implications for property that you own. There are many phases to real estate transactions, and it is important to have an experienced real estate lawyer there to guide you. Our real estate attorneys assist with all aspects of real estate, including:
- Title searches
- Division of real estate
- Closings
- Zoning and variances
- Purchase and sale agreements
- Escrow
Our firm is deeply rooted in the Little Chute community, and our real estate attorneys have helped our friends and neighbors with real estate purchases for more than 75 years. We can also assist you if you are considering passing real estate on through a will or probate.
Giving valuable guidance if you have chosen “sale by owner”
If you are considering selling your home or other property, but are wary of potential realtors’ fees, posting your property as “for sale by owner” (FSBO) may be the solution for you. A typical realtor’s commission can be six percent or more, and can equal tens of thousands of dollars from the final sale. Using a real estate attorney to guide you through the sale process can be more efficient and affordable, ensuring maximum return on investment for the sale of your home. If you are considering the FSBO option, speak to one of our real estate attorneys to learn more about the requirements.
Understand your rights during foreclosure
Wisconsin statute 846 outlines the foreclosure process. Someone whose property is subject to foreclosure has several key rights. For instance, every person subject to a foreclosure action must be notified in accordance with Wisconsin’s Rules of Civil Procedure and allowed 20 days to file a response with the court. A foreclosure proceeding cannot commence unless the defendant is given proper notice of the foreclosure action.
Wisconsin’s redemption periods are also critical if you are facing foreclosure. A redemption period grants you time to pay off an outstanding mortgage before a foreclosure sale is held. The length of time is set by the court, and can vary depending on certain factors. Property specifically 20 acres or more can have a redemption period as long as 12 months, while properties with family dwellings can be given a period ranging from three to six months, depending on the particular circumstances of each case. Our real estate attorneys are some of the best lawyers in the area for real estate and foreclosure law, and they can help you understand more about the foreclosure process and your options.
