Understand your rights during foreclosure
Wisconsin statute 846 outlines the foreclosure process. Someone whose property is subject to foreclosure has several key rights. For instance, every person subject to a foreclosure action must be notified in accordance with Wisconsin’s Rules of Civil Procedure and allowed 20 days to file a response with the court. A foreclosure proceeding cannot commence unless the defendant is given proper notice of the foreclosure action.
Wisconsin’s redemption periods are also critical if you are facing foreclosure. A redemption period grants you time to pay off an outstanding mortgage before a foreclosure sale is held. The length of time is set by the court, and can vary depending on certain factors. Property specifically 20 acres or more can have a redemption period as long as 12 months, while properties with family dwellings can be given a period ranging from three to six months, depending on the particular circumstances of each case.
