How spousal support is calculated in Wisconsin
Wisconsin statute 767.56 lays out the factors that a judge can consider when determining the level of maintenance one spouse may need after a divorce. These factors include:
- The length of the marriage
- The division of property
- The earning capacity of the spouse seeking maintenance
- The tax consequences of an award for both parties
- Whether one party contributed to the education, training, or increased earning power of the other
- The age and physical and emotional health of the parties
- The educational level of each party at the time of the marriage
- The feasibility of the spouse who is requesting maintenance becoming self-supporting
- Mutual agreements the parties made prior to the marriage
- If there are any existing child custody obligations
The statute also allows a judge to consider “such other factors as the court may in each individual case determine to be relevant.” This allows a judge broad discretion to consider all the factors surrounding your marriage and divorce when determining spousal support and maintenance.
